Recognition of Industrial Property titles in French Polynesia

According to Law n° 2004-192 of February 27th, 2004 organizing the Statute of Autonomy of the French Polynesia Territory, Industrial Property titles (patents, utility certificates, trademarks, designs and semiconductor topographies) filed with the French Office as from March 3rd, 2004 are no longer protected into French Polynesia.

In order to put an end to this lack of protection, State law n°2013-14 of May 6th, 2013 and Decree n°1002/CM of July 22nd, 2013 have settled the following acknowledgment system:

1-      Automatic recognition of Industrial Property titles filed with the French Patent and Trademark Office before March 3rd, 2004. No formality required.

2-      Optional recognition of Industrial Property titles filed or renewed as of March 3rd, 2004 until January 31st, 2014.

The recognition of Industrial Property titles, still in force, has to be requested before the Polynesian authorities, by filling out an appropriate form and paying a fee.

As from February 1st 2014, extension of protection to French Polynesia can be requested at the time of filing or renewal of a title with the French Office, an additional fee must be paid.
